The latest issue of Glosa (3/2024) features an article titled: “Foreign-language descriptive elements in trademarks – commentary on the Supreme Administrative Court ruling of 4 October 2022, II GSK 1014/22”, authored by our colleague Paweł Poznański, attorney-at-law.
The commentary explores the relationship between trademark descriptiveness and the Polish Language Act. It also examines the role of opinions issued by the Polish

Language Council and the relevance of public opinion surveys in assessing the general public’s familiarity with English in proceedings before the Polish Patent Office.
The analyzed ruling concludes a long-running case concerning the refusal of trademark protection for ICE Coffee, and is the second decision by the Supreme Administrative Court in this matter.
